Property/Tenancy Disputes

The following examples are situations where we frequently advise and take or defend proceedings on behalf of clients :-

  • Where a landowner needs to take or defend proceedings in relation to the extent of his boundary or rights over his or adjoining property
  • Where one joint owner of a property requires the property to be sold and the other owner refuses to sell
  • Where a landlord needs to serve proceedings on a tenant to recover possession
  • Where a landowner needs to evict squatters
  • Where an occupier is entitled to defend possession proceedings brought against him or her

Residential Possessions

At Neves we offer a possession service to assist you in the recovery of your property from tenants. We can prepare and serve the required Notices and then issue proceedings on your behalf.

If you are seeking possession of your property for breach of the tenancy agreement including rent arrears then we can prepare the claim form and particulars of claim on your behalf, file them at court and then represent you at the court hearing. Alternatively, if you are only seeking possession and wish to make no other claim and your tenants have an assured shorthold tenancy you may be able to recover possession using the accelerated possession procedure. This procedure allows a judge to order possession without the need for a court hearing and therefore can be a lot quicker.

If you would like to instruct us to act on your behalf for claims using the accelerated possession procedure or possession for the non-payment of rent we offer a very competitive fixed fee of £750 inclusive of VAT and disbursements provided that the matter is undefended.

Whether you require possession because the tenancy has expired, you have squatters, there are rent arrears or any other breach of the tenancy agreement we can help you recover possession of your property.

We have prepared a brief guide to possession proceedings which can be downloaded here in an online version or here in a printable version.  For further information contact James Harvey
