An article which appeared in The Observer newspaper on 18 July 2010 reported that wealthy young British men are increasingly entering into prenuptial arrangements as attitudes change. Research indicates that men under forty-five who earn more than £100,000 a year are three times more likely to have a prenuptial agreement then those aged over forty-five. Many who were interviewed for the research said that they were concerned about the current state of the law which provides for a presumption of a fifty-fifty division of assets with a former wife. Three quarters of those interviewed said that as they felt they made a greater financial contribution to the relationship they should be entitled to a larger proportion of the assets if the parties separated.
Although prenuptial agreements are becoming increasingly common, they still only have persuasive value in the event of a divorce and the Judge may disregard them or only partially accept them. Nevertheless where there are significant assets or are likely to be, it is increasingly advisable for the holder of the greater share of the family’s assets to take advice on entering into a prenuptial agreement.
